Acceptance of Terms and Conditions

Any User of the Services (“Users”) include “Students”, who have already registered with the Site and have current paid access, whether payment has been made by the User or on their behalf, to any of the courses or programs or other materials, referred collectively as “Courses”. Users can be referred to as “Visitors”, if they are not Students, or if they are Students accessing unpaid content or material. This Agreement is applicable to all Users, also referred to as “you” or “your”.

Any use of this Service implies that you acknowledge the Agreement, and agree that you will comply with this Agreement, including any additional terms and conditions provided to you in relation to the Services and other material offered to you or made available to you (“Additional Terms”). Please refer to our privacy policy (“Privacy Policy”), earnings disclaimer (“Earnings Disclaimer”) and the Additional Terms, which are hereby incorporated into this Agreement. The Additional Terms shall override in the event that there is contradiction between this Agreement and Additional Terms.

If you are not a resident of Australia, any personal information you submit by using this Site will imply that you consent to the transfer of your personal information to Australia. This Agreement is subject to modification from time to time. Continued use of the Services following any modifications to this Agreement constitutes agreement to the modified Agreement. Both the Terms of use and the Privacy Policy may be updated. The date of the most recent update will be displayed at the beginning of the document. You will need to check for any changes to the terms of use. Any changes are immediately effective, hence any use of the Services after the effective date will mean that you acknowledge and agree to the changes.

Eligibility

A condition of using the Services is a minimum age of 18 years old. By using the Services, you declare that you are at least 18 years old. As such, you represent, covenant and warrant that you meet this minimum age, as the Services are not developed for users who are under 18 years of age.

User Registration

Accessing or utilising any aspect of the Services, features, and/or functionality, you are required to personally register for a User Account using your unique email address (username) and password combination (“User Credentials”). Additional personal information may include, without limitation, your email address, name, and any other information, collectively, a “User Account”.

Any account information you provide to register is acknowledged by you as accurate and true. It is your responsibility to ensure that this information is updated promptly during the time you remain a registered User of the Services. Registered Users are responsible for maintaining confidentiality of your User Credentials, and you are liable for any access to or use of the Services by you or any other person or entity using your User Credentials.

It is imperative that your User Credentials are not shared with anyone, and you apply due diligence when accessing your User Account from a public or shared computer to ensure others do not have an opportunity to view or record your User Credentials or access your User Account. In case of any security breach or unauthorised use, you agree to immediately contact us.

Access to and Usage of the Services

Any access to and Usage of the paid Services is limited to Students. The Users have permission to access course content provided they comply with the copyright and terms of use in the case of free material and pertaining payment in the case of paid content. Access to paid Services will be denied if paid access has lapsed or if there has been any violation to the terms of this Agreement.

Free services may be offered to Users or unregistered Visitors. We reserve the right to amend or completely withdraw the Services without notice. In case any part of the Services becomes unavailable at any time for any period, we will not be liable. Registered Users and others may have restricted access to some or all parts of the Service from time to time, as determined in our sole discretion.

You further accept and acknowledge that content in particular Services may be restricted by technology, including digital rights management technology, in order to protect digital information and content from unintended and unauthorised use and access. Using this Service implies that you agree to comply with these rules and restrictions at all time, and shall not violate or attempt to violate any of these security components.

Term and Termination

This agreement shall remain effective for the whole time you use the Services. Frontend Simplified has the discretion to terminate this Agreement and/or suspend your use of or registration to the Services at any time and for any reason. Your obligations under this Agreement, the Privacy Policy, Additional Terms, any indemnifications, warranties, and limitations of liability will remain effective even after termination or suspension of this Agreement and/or use of Services.

Payment Information and Course Cancellation

For the duration of the time you purchase any products or services on or through this Site, you declare that you are at least 18 years of age, and that you abide by your agreement to promptly pay, in full, any and all applicable fees and charges, including all applicable taxes. Any incorrect information or failure to pay all such fees may result in the termination of your User Account.

You are responsible for updating your payment methods. If the payment method used has expired, and you fail to update details with your new payment method, it is your responsibility to cancel your User Account. The payment method provided will continue to be used until such time that you edit your payment information. You agree and acknowledge that we may continue to bill such payment method and you will be solely responsible for any uncollected amounts.

All payments are non-refundable except as outlined in our job guarantee terms & conditions. If you choose a payment plan option, please note that these plans are non-cancellable. Once committed, you are obligated to complete all payments as scheduled. Frontend Simplified unconditionally reserves the right to cancel your plan at any time.

You agree and acknowledge that third-party operational service providers, including third-party payment systems associated with purchases via the Site, will be used. All purchases made through these third-party services are also subject to their respective terms and conditions of use. Frontend Simplified has the discretion to replace its third-party payment service at any time without notice to you.

Privacy

Your privacy is respected and your personal information is protected. Please refer to our Privacy Policy for details regarding the collection and use of information. You are encouraged to read the Privacy Policy to help you make informed decisions.

Earnings

You recognize and agree that we have made no implications, warranties, promises, suggestions, projections, representations or guarantees whatsoever to you about future prospects or earnings, or that you will earn any money, with respect to your purchase of Frontend Simplified products, and that we have not authorized any such projection, promise, or representation by others. Please refer to our Earnings Disclaimer for more details.

Intellectual Property Rights

We and/or our licensors fully own all rights, title and interest in and to the Services, including but not limited to all audio visual content, artwork, images, photographs, illustrations, graphics, patterns, designs, logos, motifs, style, copy, text, computer code, software, music, data, user interfaces, visual interfaces, information, materials, and all copyrightable or otherwise legally protectable features of the Services.

All our material is for personal use only and the user may not modify, copy or use any material developed by Frontend Simplified for any commercial purpose; remove copyright or claim this material as their own. The right of use of all materials will cease immediately if it is found that the user has violated any of these rules and restrictions.

You shall not reproduce, alter, adapt, reshape, create derivative works from, exhibit, perform, publish, circulate, disseminate, advertise or broadcast to any third-party, or otherwise use the Services, including any content, without the express and prior written consent from Frontend Simplified. Framing, scraping, in-line linking, spidering, phishing, database scraping, automated copying, indexing, or storing content made available through the Services is strictly prohibited unless expressly authorized in writing.

Third-Party Services and Content

Frontend Simplified may provide links to third-party resources from our Site and may publish or otherwise provide access to content developed by third parties on our Site. You acknowledge and agree that links to third-party websites, content, data, information, applications, goods, services or materials do not constitute an endorsement by us.

We do not verify, endorse, or have any responsibility for Third-Party Services or any third-party business practices, including their privacy policies. Third-party websites have their own terms of use and privacy policies as well as their own content, which is not endorsed by Frontend Simplified. The use of third-party sites is at the user’s own discretion.

User Content

You and other Users may be provided with opportunities to take part in message, comment and communication features on the Services, including communities, chat rooms, personal profiles and forums. This includes opportunities to submit, post and otherwise make available content, messages and other information via the Services, collectively, “User Content”.

You represent, warrant and covenant that you own any and all User Content you make available or otherwise have the permission to grant the rights, licenses and privileges described in this Agreement. We do not acquire title or ownership rights in User Content that you submit and/or make available.

By submitting User Content on the Site, you grant to us a non-exclusive, irrevocable, royalty-free, worldwide license to use, reproduce, create derivative works of, publish and distribute such User Content. You agree that all User Content is the sole responsibility of the person from which such User Content originated.

You may not submit, post, email, display, transmit or otherwise make available any User Content that is unlawful, harmful, threatening, abusive, defamatory, deceptive, fraudulent, invasive of privacy, harassing, obscene, discriminatory, vulgar, explicit, graphic, promotes hatred or physical harm, contains adult links, infringes rights, creates a security or privacy risk, contains malicious code, or may be construed as violating this Agreement.

Communications

The Course or courses may provide you with the ability to send messages to the Discord Server, and communications to other Users and/or us. You agree to use communication methods available on the Courses only to send communications and materials related to the subject matter for which we provided the communication method.

If you are a Student, you provide your consent to receive communications and notices that we provide in connection with your User Account and your use of the Services. Notices may include email, in-Site messaging and chat communications, promotional, marketing, and advertising information, and administrative or transactional notices.

Monitoring of the Services

Frontend Simplified assumes no responsibility or liability for monitoring, or failing to monitor, the Services for inappropriate content or conduct. However, if at any time Frontend Simplified chooses in its sole discretion to monitor the Services, Frontend Simplified nonetheless assumes no responsibility for User Content, assumes no obligation to modify or remove any User Content, and no responsibility for the conduct of any User.

Frontend Simplified reserves the right to review any User Content and to delete, remove, move, edit or reject, without notice to you, for any reason or for no reason whatsoever, any User Content that is or may be construed as violating this Agreement or is deemed unacceptable to us.

Copyright

We respect the intellectual property rights of others. It is our policy to respond to any claim that content posted on the Service infringes on the copyright or other intellectual property rights of any person or entity.

If you are a copyright owner or an agent thereof and believe that any content on the Services infringes upon your copyrights, please contact us at Info@simplified.org with a physical or electronic signature, identification of the copyrighted work, identification of the allegedly infringing material, contact information, a good faith statement, and a statement that the information in the notification is accurate and authorized.

Please note that you may be held accountable for damages, including costs and legal fees, for misrepresentation or bad-faith claims on the infringement of any content found on and/or through the Service on your copyright.

Indemnity

You agree to indemnify, defend and hold Frontend Simplified, its affiliates, successors and assigns, directors, officers, employees, representatives, agents, licensors, advertisers, operators, suppliers and service providers harmless from any and all claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising in any way out of or in connection with your use of the Services, your breach and/or violation this Agreement, and/or your User Content.

You are solely responsible for your interactions with the Site and associated Services. To the extent permitted under applicable laws, you release us from any and all claims or liability related to any product or service provided by third-parties, any action or inaction by third-parties, and any conduct or speech of any other user.

DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

Frontend Simplified is not responsible for the applications the Users make of the information learned from this website. Our mission as an education portal is to provide current and relevant information required to learn each programming language available in this website. We are not liable for what the User programs or builds with it, nor make any promises about any end results beyond giving enough tools to the user for learning each subject.

The Services, content, products, third-party services and User content made available on, through or in connection therewith, are provided on an “as is” and “as available” basis, without any representation, warranty or condition of any kind, express or implied. All implied representations, warranties and conditions relating to the services, this site, content, products, services and user content are hereby disclaimed.

To the fullest extent permissible by law, Frontend Simplified and its affiliates shall not be liable for any loss or damage, direct or indirect, in connection with or arising from use of the services or from this agreement, including compensatory, consequential, incidental, indirect, special or punitive damages. In jurisdictions where exclusions or limitations do not apply, our liability will be limited to the fullest extent permitted by applicable law.

LIMITATION ON TIME TO FILE CLAIMS; WAIVER OF CLASS ACTIONS

Any provision which must continue in order to allow us to enforce its meaning shall survive termination of this agreement. No action arising out of this agreement and/or the services may be brought by you more than one year after the cause of action has arisen. Where permitted under applicable law, we each agree to bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative action.

Geographic Restrictions; Export Control

The Services are controlled and operated by Frontend Simplified from Australia. We make no representation that the Services are appropriate or available for use outside of Australia. Those who choose to access the Services from other locations do so at their own risk and are responsible for compliance with local laws, rules and regulations.

General

If any provision of this Agreement is held to be illegal, invalid or unenforceable, this shall not affect any other provisions and this Agreement shall be deemed amended to the extent necessary to make it legal, valid and enforceable. The failure of Frontend Simplified to exercise or enforce any right or provision of this Agreement will not operate as a waiver of such right or provision.

All matters relating to the services and this agreement and any dispute or claim arising therefrom or related thereto shall be governed by and construed in accordance with the internal state laws of New South Wales (NSW). Any legal suit, action or proceeding arising out of or related to this Agreement and/or the Services shall be instituted exclusively in NSW and courts located in Sydney.

Headings used in this Agreement are provided for quick reference and convenience only and shall not be used to construe meaning or intent. This Agreement contains the entire understanding and agreement between you and Frontend Simplified concerning the Services and supersedes any and all prior or inconsistent understandings relating to the Services and your use thereof.

This Agreement continues to be modified and the date of the last modification will be indicated above and is effective immediately. Always check for any changes to the terms of use.

Revision and Errata

The materials on this website may include technical, visual mistakes or typos. We do our best to have the materials proof-read and mistake-free but if you see any mistakes let us know and we will do our best to correct them!
